So the old GM used to pay into a fund to help with recycling mercury out of old GM vehicles. Now since it is no longer the same company they see no reason to pay into this fund. As quoted from the article: GM spokeswoman Sharon Basel said GM's former entity remains a member of the partnership. The new automaker, however, "has never produced vehicles with mercury switches and has no mercury switch responsibility under the terms of the bankruptcy court order," Basel said.

Nice corporate responsiblity there GM. They should have let you FAIL
